Welcome to Lumen Deluxe. These Terms of Service ("Terms") apply to your use of lumendeluxe.com (the "Site") and to any purchase you make from us. In these Terms, "Lumen Deluxe", "we", "us" and "our" refer to Lumen Deluxe, and "you" refers to you, the customer. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By using the Site you confirm that the information you provide is accurate and complete. Our store currently serves customers in the United States.

2. Products and Descriptions

We do our best to describe and display our products accurately, including dimensions, materials and finishes. Colors may look slightly different depending on your screen, and minor variations in size, finish or packaging may occur. Product images are for illustration, and decor or props shown in photos are not included unless stated. Please check measurements and specifications before ordering.

3. Lighting Installation and Safe Use

Many of our products are electrical. Please read and follow all instructions and safety warnings included with your product. Hardwired fixtures, such as ceiling lights, pendants and wall sconces, should be installed by a licensed electrician in line with local building and electrical codes. Use bulbs of the type and wattage recommended for each fixture, and only use outdoor-rated products outdoors. Lumen Deluxe is not responsible for damage or injury caused by improper installation, misuse, or modification of a product.

4. Pricing and Availability

All prices are listed in US dollars. Prices, promotions and product availability may change at any time without notice. We reserve the right to limit quantities and to discontinue any product. If an item you ordered becomes unavailable, we will let you know and issue a full refund for that item.

5. Orders

Your order is an offer to buy. We accept your order when we confirm it by email. We may refuse or cancel any order, for example if a product is unavailable, if there is an error in price or description, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full. You can cancel your own order within 1 hour of placing it, as explained in our Return & Refund Policy.

6. Payment

Payment is due when you place your order. You agree to provide current, complete and accurate payment information. Details about accepted payment methods, sales tax and security are in our Transaction Policy.

7. Shipping and Delivery

We ship to addresses within the United States. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when your order is delivered to the shipping address you provided. Full details are in our Shipping Policy.

8. Returns and Refunds

Returns, refunds and cancellations are covered by our Return & Refund Policy, which forms part of these Terms.

9. Your Account

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Please let us know right away if you believe your account has been used without your permission.

10. Reviews and Communications

If you send us reviews, photos, comments or other content, you confirm that it is your own, is accurate, and does not break any law or the rights of others. You give us a non-exclusive, royalty-free right to use, display and share that content in connection with our store. We may remove content at our discretion.

11. Acceptable Use

You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, to upload viruses or harmful code, to collect other users' information, or to copy, scrape or resell our content or products without our written permission.

12. Intellectual Property

All content on the Site, including text, graphics, logos, images and design, belongs to Lumen Deluxe or its licensors and is protected by intellectual property laws. You may not copy, reproduce or use any of it without our written permission. Product names and brands may belong to their respective owners.

13. Third-Party Links and Services

The Site may contain links to websites or services run by others, such as payment providers and shipping carriers. We are not responsible for their content, policies or practices, and your use of them is at your own risk.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

15. Disclaimer of Warranties

Except as expressly stated in these Terms or required by law, the Site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will always be available, error-free or free of viruses. Nothing in these Terms limits any rights you have under applicable consumer protection law.

16. Limitation of Liability

To the fullest extent permitted by law, Lumen Deluxe will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations of liability, so some of these limits may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Lumen Deluxe and its owners, employees and partners from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site or our products.

18. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts and the federal laws of the United States, without regard to conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Massachusetts, unless the law of your state of residence requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

20. Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in full effect.
